I live in Canada and my fiancé is in IL. We can get married any time, here
in Canada or in the US. We are together for 5 years, and we want to get
married. We bought a house in Chicago and it is going to be ready by
December 2004. At this point on time, I want to get there ASAP to get
married and to start looking for a job. Currently I have a very good job in
Canada and I am sure that I will find another one pretty quick there, but
first I will need the EAD. I understand that this days the K-1 visa process
can take up to one year; a thing that will put allot of pressure on me to
find a job before we are moving into the house to start paying the mortgage.
We are waiting to NOA1 for the K-1.
I hope this information is sufficient.

BCIS says it is shorter to file for a K-1, but in the info I have read,
K-3 was in response to the longer times it was taking to previously get
a spouse into the US.
As I understand it, BCIS is making "reunification" of famlies a priority
with the creation of the K-3, am I incorrect? I.E. a case is
automatically "current" with a K-3 filing? Frolynkaya? anyone can
comment?

If you can get married promptly, the K3 visa will most likely come faster than the K1 for you. Your fiance lives in the area served by the Nebraska Service Center, the slowest of the 4 regional servide centers.

A guy I work with got a K-1 for his wife, and it took almost 12 months to
get through the California Service Center. My lawyer said that a K-3 would
be quicker. So, we got married in Panama and submitted the paper work. We
got married on April 11th and we still don't have a Visa yet.
The biggest delay so far was getting the marriage license from the
Panamanian government. That took two months, instead of the 5 to 10 days
that they said. Of course, once you get the paper work together, you have
to first file the I-130 for the green card and get the receipt. Then you
can file for the K-3. It tooks us 3 months to get through all of this and
apply for the Visa. We have a receipt date, NOA1, of 8/5/03 for the K-3 and
we are still waiting for approval.
I think overall, the K-3 is a quicker way to go. But, you are subject to
the random starts and stops of Visa processing. In July, people were
getting approved in about a month, and getting the Visa in 2 to 3 months.
Then, in late August, they pretty much stopped processing K-3s. They are
now over two months behind. We are starting to see approvals again, so
hopefully they are working on them again.
Of course if you apply for the K-1, you are subject to the same BS, but in a
different office.
I am praying for an approval any day. And if it comes, it will be 4 to 6
weeks after that for the Visa to be issued.

On October 1'st The Nebraska Service Center was processing I-129f applications dated...March 7'th. To that time you add about a month in your case (more or less with no guarantees). So if you went the K-1 route and you had applied on March 7'th call it November 1'st at the earliest.
The latest report for the Missouri Service Center is September first. On that date the report says that they are processing I-130 applications dated April 17'th. BUT...this is reported to be an error. From the mediabrew timeline posting the latest seems to be thaton October 3'rd they have processed at least one application dated July 22. So call that six weeks. Add you month for NVC and consular process ing brings you to Call it three months (Again more or less no guarantees).
To add to all this confusion things are always in a state of flux with the INS/BCIS/USCIS/CIS and they are supposed to be speeding up (HA). ll that being said... I would go with the K-3...and did.
There is no way of knowing in advance the answer to your question. Make your choice and don't look back. You will have setbacks and minor delays no matter which route you take IMO. Just start the process and topple one domino at a time...you will get there.
