Default Divorcing before 2-year card expires

Hi,

Wondering if someone may have info or experience that can help me. I had a
successful AOS a couple years ago. However, the marriage did not work out,
and we are getting divorced after being separated for a year. We were
married and living together for about a year and a half before separating.
My 2 year green card expires this upcoming March. I think I am supposed to
apply for the removal of conditions or something 90 days before the
expiration of the card.

However, given the fact that we will be divorced (after 3 years of marriage-
though as I said separated after 1.5 years) what is going to happen to me? I
suspect that they will not give me a new green card. Am I wrong for thinking
this? Am I going to have to leave the country?
Anyone know what will happen?

download this form and read the instructions. This is the form you have to
file 90 days before the expiration.
However, if you divorce before that, you can file it as soon as divorce is
finalized. Submit all types of evidence listed in the form instructions as
examples and more. everything you can find. ask few friends to write a short
affidavits, confirming that your marriage was real. also submit a long
personal and emotional letter telling your story, and ask your spouse to
write a story too.

after you file it, you'll get NOA paper, extending your card for another
year and indicating that it will take xxx days to process your form.

its very likely that you will be called for an interview, but it should be
quick and painless if everything was done right.

if after reading the instructions on a form you still have questions, and/or
you feel your evidence is not very strong, get a lawyer to file it for you.

Has the relationship broken down so irreconcilably that your spouse won't do
you a favor and remain married until after the two years?

It might be a year or more before an I-751 interview. If they have to
remain married for I-751, then that would indicate there is something
fraudulent to begin with. Getting divorce after 1 1/2 years doesn't make
the original marriage fraudulent. In fact, he can even file I-751 by
himself if he is divorced.
