OK, so I'm well and truly confused....

I'm a USC born and living in the UK. My husband and children are going through the IR1 & IR2 visa process and have their medicals booked for the end of Jan.

My confusion is, do I need to complete an I-864EZ form for my husband? It's referring to my Federal income tax - should I just provide my UK tax details and P60s?

Also, am I right in completing the I-864W forms for my children - I'm guessing so!

Any help is greatly appreciated

Have you been filing a US tax return each year? As a USC you are required to report all worldwide income to the IRS each year. If you haven't been doing this, you'll need to submit at least the most recent 3 years of US tax returns to the IRS, and include these along with your I-864.

I didn't look up the I-864EZ requirements, but I have a feeling you won't qualify for that one, and should use the regular I-864 form.

The children need I-864W, correct, unless you are able to pass along your US citizenship to them now, in which case they'll need US passports.

How are you planning to meet the income/ asset requirements on the I-864?
