Complex questions!
Hi there
We are Canadian permanent residents living in Canada but UK citizens and my husband will possibly be offered a job based in the US for a company who has a head office in the UK and another in the US. Will he be able to carry on living in Canada but visit his clients in the US? Can he accept a contract from the US office without any visa requirements or would it be best to get it drafted from the UK office. What about getting paid, will it be a problem to get paid in US funds?
He can apply for his Canadian citizenship in about a years time, would that make things a whole lot easier for working for this company?
Thanks for your time.

Re: Complex questions!
Just seen that there is another forum called USVisas which might suit my question better so I've posted on there too.

As for citizenship, it should, if the type of work is covered under NAFTA.

Also to be noted, other than the fact that your husband cannot work in the US without a work authorized visa, he has to determine what the ramifications will be for his Canadian residency if the company can manage to get him a L-1 visa.
If, however, he is employed by this company but only visiting the US from time to time and not actually working there on a daily basis, then he might be fine with residing in Canada and flying/driving down periodically.
As for the TN-1, it is only open to Canadian citizens and other than as Bob mentioned must be in a category listed on the NAFTA positions, he must also have the degree required for that position.

Re: Complex questions!
He would be working for the company and covering Canada and the US. He would be based from a home office in Canada and just visiting clients in the US from time to time.
The residency is fine, we don't have to be employed by a canadian company to live in Canada as we are permanent residents and as long as we maintain residency as 2 years out of 5 that covers that.
Then T visa would be something he might do in the future after he has become a Canadian citizen next year.
I guess it sounds like it is possible if he is employed by the UK side of the company.
I think for an L visa he has to be employed for a year by the company so the could be a possibility too if he could just get by the first year.
Thanks for your replying!
