Hey all,

So yet again another question based on this! I now understand that I can use my income as the immigrant, thanks to a couple of members here, but I just need clarity on these points;

1) by the time we file for a VISA and start the application, we'll only be recently married - will I still be able to use my income on the affidavit of support to hit the threshold as its continuing from the same source?

2) are there any conditions we must meet? I read somewhere that you have to have lived together and/or the immigrant is named as a dependant on tax returns? Being in the UK we can't live together and, also we don't do the same taxes - how will this work?

3) will the fact that I'm moving from the UK to USA impact me being able to use my income? It'll be from the same employer.

1) I doubt it - the length of your marriage and your income continuing are quite separate

2) No, that won't be an issue - my wife filed her US taxes as "married filing separately" and put for spouse's name "non-resident alien" (so didn't even mention my name) and there were no issues.

3) No, I did exactly that.

The length of marriage is irrelevant. Your income can be used, it doesn't matter how long you've been married.

You will have been married about 5 or 6 months by the time the I-864 is due.

I'm a bit curious as to why you continue to wonder whether or not your income can be used. Have you found something official that says that you need to be married for x length of time? Answer = no!

Did you read that on any official US immigration form? Answer = no!

You keep looking for issues where none exist. Please stop!

You're right - that's exactly what I'm doing, it's a habit I need to get out of. I do it with everything, assume the worst, I'm looking for problems where none exist. Thanks again!
