What? Nonsense! Having an IR-1 in process proves you know the correct procedure and are following it. The attorney is an idiot... and he should have known better! Dear god... I hope you're not paying this guy anything!

That's why I wrote 'retrospective'. You can specify the year you changed your name.

Ian's right. I went to visit my wife twice during the visa process. I just took letters from my boss that I was expected to return to work each time. The second time I even took a copy of the e-mail I got for my US Embassy appointment. You just need to take proof you're gonna go back to your homeland afterwards.

Situations like this can cause no end of problems. However, when I was in practice, I discovered a relatively easy way to fix this: obtain a STATE name change judgement. The other solutions given in this thread are correct as a matter of law, but they don't really fix the potential problems.

Being that you are British and are talking about a UK birth certificate and name change, I can't phantom how you can get a STATE name change judgment. I see Brit In Paris replied and he is the expert in all things regarding Birth Certificates and passport.
