urgent answer needed for immigration court cases, time expiring soon please reply
 
Hi everyone, I need urgent help. I took my immigration case to federal court in Melbourne , Australia and i received a negative decision,

Now I want to apply for full bench high court or high court but I'll. It have much time because Christmas holidays are coming . I want to apply as soon as I receive the negative decision so I can stay here legally.

tell me whole process including the cost involved.

how do i apply for bridging visa A so i can stay on a visa while my court decision is pending?

Please tell me any less expensive lawyer/ barrister who can only file a application on my behalf.

Or if someone else can file it for me and guide me through it.

I cannot spend thousands of dollars as I don't have much money left .

Please reply urgently and provide me contact info of the person.

i do not want to spend any money. all i want to do is to apply for the appeal , that's it. i can spend a few hundred dollars for application .

or if i can lodge the application myself without any barrister.

i want to do all of this before Christmas

its December 24th, and its a Sunday. You cannot do anything about it before Christmas.

Yes - if you require urgent, immigration advice, consult a MARA agent after the holidays.

Yes I do. It's Christmas. All official people are on holiday and all unofficial people are doing what they do on christmas day. This is not urgent.

And as he wanted the answer before Christmas but didn't post till late Christmas Eve its pretty pointless anyway!

Well as you only typed the post yesterday (Christmas Eve) there was absolutely no chance of doing any of it before Christmas.

You really need an agent so I suggest waiting a few days then phoning around to get prices.

If you want any constructive advice then you'll need to give a bit more background. What passport(s) do you hold? Which visa(s) have you held whilst in Australia? Why was your last visa refused/cancelled? What reasons were given for your appeal being turned down?

Drafting a Notice of Appeal or Cross-Appeal is very difficult. It is therefore strongly recommended that a Notice of Appeal be prepared with legal assistance.

There are organizations which may be able to provide free or low-cost legal advice or assistance to a person who does not have a lawyer.

Court staff cannot provide legal advice.

A party who loses an appeal will usually be ordered to pay each of the other party's legal costs, which is a lot of money because appeal attorneys charge hundreds of dollars per hour.

Appeal forms are available from www dot fedcourt dot gov dot au/law-and-practice/guides/appeals/from-courts.

If you want to appeal and do not care if you lose, than you can file the appeal yourself. There will be a significant filing fee, unless you claim and prove that your are indigent (too poor to pay the filing fee). Be aware that appeals very, very rarely succeed, cost tens of thousands of dollars, and take many months or several years to complete. However, your appeal can be thrown out within weeks for failure to prosecute your case if you miss any of the many filing deadlines for complicated legal briefs. (Remember there is a reason that appeal attorneys can charge hundreds of dollars per hour for their work.) You might be better off using your limited funds to get you to your next destination.
