Default Sponsorship limitations for fiance visa subclass 300

Hi all... I am writing this post on behalf of a friend of mine and hoping one of the migration agents who frequent this forum to help us out with this query. My friend sponsored his girlfriend who is resident in the Philippines on a fiance visa and she subsequently was granted the fiance visa (subclass 300). She stayed in Australia for just over 3 weeks and then due to emergency with one of her family members she had to leave. To cut the long story short her fiance visa expired after 9 months and they never got married but they still maintained contact and are still very much in love. His concern now is whether he is going to be able to sponsor her again for another fiance visa knowing there is a 5 year waiting period before being able to sponsor again. He is not sure whether the limitation applies to sponsoring a new person or applies to sponsoring his girlfriend as well. We would be really grateful to anyone who can confirm if he is able to sponsor again or not. Cheers

This is a free forum and most of us are lay people, although I am sure someone could easily answer, but if you particularly need it hear this from an agent then you need to contact one. I don't think there are regular migration agents on here. Although they do pop up from time to time, so you might be lucky.

I THINK they would be OK, as the rule is in place to prevent people sponsoring multiple spouses in turn. However the question isn't answered in the Partner booklet and I suggest you actually contact a registered agent with the question. Most will give you a basic consultation free or very cheap.

The five year limit applies to sponsoring a different person. Your friend just needs to lodge a new application.
