I was in a similar situation but from Nz.
so 444 visa didnt cancel the 175 visa .
why ETA would?

Different visa have different conditions.
A 444 to a 175 is TOTALLY different from the OPs situation.

Applying for a ETA whilst already holding a 175 can cause cancellation of the 175. The OP should get professional assisstance regarding a RRV.

Please do not give immigration advice unless you are sure that the advice you are giving applies to the particular situation under discussion.

I thought applying for any visa, 444 and eta included ,wouldnt cancel the 175.
there is no reason getting 444 not to cancel but any other to cancel 175.
there must be logic in it.

Its not a clear cut situation.

We have had people post in here in the past who have got an ETA or a WHV to return to Aus, while holding a PR skills visa (175, 189, 136 etc) because they mistakenly thought they could only get a RRV onshore.

From memory - at least one case they were told their PR had been cancelled by the ETA and was gone forever. No appeal. End of. Back to the UK.
There was also at least one case where the PR holder appealled and won, and their PR visa was reinstated -but it had been cancelled by the ETA initially and it took money and time to sort the mess out.

Technically, I am told, the isse of a subsequent visa cancels all previous visas, as a person can only hold one visa at a time. thats why its important to keep a case officer informed of any tourist visa applications whilst waiting for the grant of a PR visa. The visa granted LAST is the one that (usually) will be the one in place, over-riding all others.

If a person holding a PR visa gets an ETA and comes to Aus, gets a job and starts work, then there is a very high chance that they will be in breach of their visa conditions. They will have entered Aus as a tourist, which means they cannot work. And even if the Pr by luck has not been cancelled, their most recent entry will have been as a tourist. Its not a mess anyone would want to get into.

I don't know the conditions of a 444, but like a 461 it is aimed at a "Special Category" ie New Zealanders and therefore may have some additional rules around it that don't apply to other visas.

I hope that helps to explain why getting a ETA is not a good idea in a case like this. Professional advice would be the way to go to maximise chances of a RRV.

Many thanks everyone for your posts here. Given my situation and the fact I have a PR Class 175 I am going to speak with a specialist immigration agent regarding the RRV, as I want to ensure I have the best chance possible.
