Hi,

I got the Australia immigration in Sept. 2011 and then was returned back from Australia after 3 months. The last date, I can enter Australia (as per stamp) is September 2016. I am planning to go back sometime early next year.

Now, we are expecting a baby and due date is November 2015. This means that the new born will be born outside Australia, which means that I have to arrange PR/visa for the new born as well.

Please can anybody confirm, what option I have for the visa/PR for my new born baby because, I cannot move to Australia before early next year due to some personal reasons.

Congratulations on the pregnancy !

Assuming that one of the parents is not an Australian Citizen, then the child will need to obtain a (child) visa, if one of the parents in an Australian Citizen then the child can apply for Citizenship by Descent.

If the child is born in Australia, then the child will be an Australian Citizen by birth.

Thanks for replying. Do you guys have any idea like how much time (estimated) this visa will take to be granted? I will be applying from a High Risk Country.

Or, if the child is born to an Australia parent, even if outside Australia. My wife is Aussie (I'm English), but even though our son was born in England, we applied for (and got) our son's citizenship certificate whilst still in the UK. So now he has an Aussie passport as well as UK. Hey presto no visa worries for him and the little tacker can come and go as he pleases. It wasn't especially cheap as I recall, but it was fairly painless.

There is a catch to that advice, if the parent is Australian but received their citizenship through descent, s/he would have needed to have spent two years in Australia to pass on citizenship. Otherwise I believe a child visa is required.

Can I submit this Child Visa (101) application online? I do not find this visa class on online services portal "ImmiAccount".

Thanks, one more query.

I am filling FORM 40CH. In section "Part K - About you home", they are asking for residential details. What information should I put there as I am not currently in Australia and do not have any home there. Once I received immigration for my new born, then I will move with the family.

Same is the case for question 25, 26 and 27. Though I have Australian Immigration but currently I am not working in Australia. I am currently working in UAE. What should I mentioned in question 25, 26 and 27?

You just need to tell them about the place you're living in. If you live in a house, tell them that. If you live in a flat, tell them that. You also need to tell them about the people are living with you, and what their relationship is to you.

For questions 25, 26 & 27, you need to tell them about your job.

According to question 20, you will need to write a statement for them to explain how you intend to meet your sponsorship obligations, as you are not in Australia.

I have submitted the application for my child for Child Visa (101). The department has asked me for additional document. One of the required document is "Evidence of contact between the applicant and the sponsor" which I don't understand. What document should I submit against this requirement?

There are two required documents in their email, which I am not able to get. Can you please suggest what document should I provide them against below:
