Question Having children - Parents have dual UK and Australian Citizenship

Hello everyone,

Random question but I suppose these kind of things need to be thought of when considering such a big move...

My partner and I are due to migrate to NSW on a SS visa in July 2015 (not yet been granted) but if all goes well we intend to apply for Citizenship once we are eligible.

My question is, if we have dual UK and Australian citizenship then have children in Australia, what rights and citizenship will our children have?
Also to consider - if we do not apply for citizenship and just remain permanent residents and we then have children, again will they automatically have UK citizenship then will need to apply for Australian citizenship once they are older or will this be automatic given they are born over there?

Thank you for your help,

(a broody but patient) Lisa

If you or your husband are Australian citizens or hold a PR visa, then your children born in Australia will be Australian citizens. If you hold a temp Australian visa, then your children will not be Australian citizens but will automatically have the same visa you have.

If you (or your husband) are British Citizens other than by descent (i.e. you are British because you were born in Britain), then your children born overseas will automatically be British citizens by descent. Note that this means that they will not be able to pass British citizenship onto their overseas-born children.

So your children born in Australia will (most likely) automatically hold dual citizenship.

That's great thanks, just one of those things you need to check!
