Criminal record !!

I am considering applying for emigration to Australia. Unfortunately I have a criminal
record. This was 18 years ago and was a drugs conviction. It was only growing two plants
in the garden for which I received a conditional discharge. In UK law this is a spent
conviction but I understand that I have to declare it on the visa application form. So,
will this make any difference? It was such a minor thing but a drugs conviction can be
such a red rag to some people. Any thoughts? Simon

My first thought is that DIMA now monitors this group and whatever is disclosed here could
go against your application. Russell

Russell Simon would have to declare it anyhow, if someone from DIMA does read what he's
posted and manages to tie it up to a later application I can't see that making any
difference.
Simon Firstly you should read DIMA factsheet 87 on the character requirement.
http://www.immi.gov.au/facts/87character.htm The fact you didn't get a prison sentence, it
was 18 years ago and the conviction is spent under UK law should all count in your favour.
But I think it would still be worth speaking to a registered migration agent who's
familiar with these issues before applying.

The current General Skilled migration booklet doesn't say, but some older DIMA publication
I have says: 'You must tell us about all convictions even if they were a long time ago and
have now been struck off the official record'
So I think the answer is yes.

Hi,
That's an impression that has been created recently. But it may not necessarily be true.
DIMA security may have only been monitoring the use of DIMA facilities by their staff as
is standard practice by all large corporations. There may be a no more sinister motive
than to prevent potential and actual damage to DIMA computer systems and/or unauthorised
outside access to confidential client information.
But, that said, some discretion is always advisable on the internet as personal
information provided is accessible to one and all.
And, yes, such things should be declared on migration application forms where
requested/required.

It certainly does George,
After having a quick look at it, it also doesn't help Simon one iota !
In fact it states that anyone with a criminal record cannot go to Australia
!! (this was on the side bar links to character & police clearances)
Which is totally incorrect. Isn't it ?
Perhaps Simon should contact you or one of the other trusted gurus for advice.

Thanks for the comments on my criminal record problem. Looking at the web site page
concerning character requirements (http://www.immi.gov.au/facts/87character.htm) it would
imply that only a substantial criminal record would cause a problem applying for a visa.
This is basically defined as serving a prison sentence. So, I think I should be OK with
this !! Simon
