Default 457 ceases and new TSS / 482 visa commences on 18th March (457 ceases))

The government have today released the legislation and regulations for the new Temporary Skill Shortage (TSS) 482 visa which will supersede the 457 as of 18th March 2018.

  • Both the Employer and Visa Applicant are required to meet a number of eligibility requirements
  • visa applicants must have at least two years’ work experience in the nominated occupation
  • there are English language, Health and Character requirements
  • Nominated position must comply with mandatory labour market testing requirements (some exemptions)
  • Salary must be above the Temporary Skilled Migration Income Threshold (TSMIT). Plus, must also be at least the Market Salary Rate for the occupation/location.
  • Two streams depending upon occupation
    • Short-Term stream: visa period up to 2 years, capacity for one onshore visa renewal, occupations on STSOL list
    • Medium-Term stream: visa period up to 4 years, occupations on MLTSSL list
  • Employers required to pay a contribution to the Skilling Australians Fund (once the legislation has been passed - still awaited) based upon the duration of the visa required
    • Small business (less than 10M turnover): pay $1,200 per nomination/year/visa duration requested.
    • Large business: pay $1,800 per nomination/year/visa duration requested.

Visa Application charges appear to be:
  • Short-Term stream: Each applicant a) 18 and over $1,150, b children $290
  • Medium-Term stream: Each applicant a) 18 and over $2,400, b children $600
