Question about 2/5 rules

Default Question about 2/5 rules

Hi, people;

I have a question about new immigration law.
You know we canadian immigrants can stay outside canada up to 3 years of
every 5 years under the new law.
Is this equal rule to not only new immigrants who got the visa under new law
but also immigrants who got the visa under old law? Because I got the visa
before new law started and I was outside canada before 26,June,2002. If this
2/5 rule is equal to any immigrant, I guess we can stay outside canada till
June of 2005 without entering canada once. Is this right ?

Please give me some advices.

2/5 residency obligation applies to all permanent residents, regardless when
they landed.

When did you land and when you left Canada? You could stay outside for up to
3 years (less one day) in 5 years period - if you landed less than 5 years
ago then such 5 years period runs from your day of landing and if you landed
more than 5 years ago then it is 5 years period counting back from the day
you are returning to Canada. Without knowing exactly when you landed, how
long resided in Canada and when you left nobody can tell you how many days,
months or years you have left before your PR status will be gone.

So I have one another question.

My residental history is following,
2001,June - First landed as a canadian immigrant
2001,June - Back to my country ( a few days after signup on imm1000 )
2001,Sep - Land seconly at canada
2002,Feb - Back to my country again
2002,June - 3 weeks at canada (and go back to my home country)
2003,Aug - 2 days at canada (and go back to my home country again
And now I am still outside canada.

I guess I will be able to stay outside canada till almost end of 2004 under
the 2/5 rule becuase this 2/5 rules runs from 2001,june.

This idea is right ?

So, you've been in Canada for about 5 months since your landing so far. You
need to be here for at least 2 years between your landing and June 2006. It
means you must be in Canada for about 19 more months before June 2006. Thus
October 2004 is the latest time you should return to Canada and stay here
continuously till June 2006.
