Independent Applicant vs H.C.C

Hi,

I need some advice on how to obtain Landing Status in Canada.

I did my whole Bachelor Degree in Electrical Engineering at the Univ. of NB (1994-2000)

Now I have a 1 year working permit that expires on Nov 21st. 2001. I have been working
for an engineering firm that offered me FULL TIME PERMANENT employment pending on my
visa status.

As an independent applicant I have 85 points but only 3 months working experience. Do
I qualify ?

My other option is ask my same sex partner to sponsor me under Humanitarian and
Compassionate Case.

Do you have any suggestions on how to submit the application ?

You don't qualify without at least 1 year of work experience after graduation. Also, there
is no way to have 85 points in your situation, regardless how hard you count - you made
some serious error or errors in self-assessment.

You have a post-graduate Employment Authorization for now and it will expire before you
are even eligible to apply for Canadian immigration visa. Your best bet is to have your
employer apply for job offer validation for you and after that is granted you should apply
for another EA before the first one expires. Then, once working on the second EA you may
apply for immigration visa as soon as you have that required 1 year of work experience.

You didn't provide enough details to make a firm evaluation but in general your case will
not qualify for H&C grounds consideration.

I think Andrew is right on this case. You will need at least of 1 year working experience,
so you will need to extend your work permit and obtain 1 year work experience at the time
you apply.

Regarding of H&C under same sex partner relationship, if your partner is a
Canadian/Canadian Landed Immigrant, it should be easy to file your case. Just have him/her
sponsor you. You will need some documents (pictures, letters, air tickets from vacations,
rent agreement-if you live together, will, etc. )that support you have bona file
relationship with your partner to show a visa officer at the interview.

If your partner is not a Canadian/Landed Immigrant, you both need to apply as an
Independent Applicant with a cover letter alerting a visa officer about your same sex
domestic partner relationship. If one of you gets accepted, other partner should be
accepted based on H&C.
