Does my son need to make a H and C application?

I'm a Canadian resident and I have just been awarded custody of my son. My son is with
me now in Canada, and I want to apply for him to stay. Should he apply on
compassionate grounds?

Hi:

In order to qualify for Humanitarian and Compassionate considerations, you must establish
that undue hardship could result to your dependent children, if he is required to apply
abroad for an immigrant visa.

If you are seeking to apply for sponsorship inland, then you will need to include an
application for exemption from landing which includes the H&C application.

Thanks Roberto,

My son is 15 years old, and he came into Canada as a visitor. His relationship with his
father has now completely broken down. Do you think we have a reasonable case to make?

If your son is still a minor, then file your sponsorship application on H&C. His status
in Canada must remain legal at all times. Also submit court authorization for custody
of your son.
