Default Zártkert Common Sense Law Change

For anyonewho owns a small plot of hobby land outside the village boundary there is a new regulation which is very important. These small land ownerships were caught up in the new Land Law as they were not distinguished from Agricultural property. A new law allows owners to have their Zártkert reclassified so it is no longer treated as agricultural land but can be sold just like any other property. See http://www.parlament​.hu/irom40/03786/037​86.pdf. It is free to take your land out of the Agricultural definition but it has to be done before 31st December 2016. You fill in a form at the local land office & that’s it.
This change will mean that sales will take about a month rather than six. The pre-emption rights will no longer be relevant so no-one will interfere with your contract of sale.
Maybe in this way sales will re-start. Owners should re-define theirland before 31st December 2016 even if a sale is not currently planned. Its free, it’s said to be simple and could have huge benefits at the time of sale.

Interesting, can such pieces of land have a postal address and receive post or do they need to have a certain type of building on them to get such a status? When I sell my house I would like to remain officially a resident of Hungary so I might need to buy another cheap property of some sort.

I am not an expert on these things but think the right to live in any building on such land, and have an official address is a different administrative matter. The resent change just takes the land outside the scope of the agricultural land regulations. Other matters have to be dealt with separately I understand and whether one gets permission is not clear - to me anyway!!

Thanks for the info, John!

Maybe that is why we suddenly saw new very prominent signs on some of these little houses in the vineyards where we walk our dog:
"xyzutca 11" etc ...

We couldn't think of a reason for this.

As John said a property having an address and the ability to get registered there as your residence are 2 different things.
People with small vineyards will often put up the address so that friends and family (and the postmen / meter readers et al) can find them easily or at any rate easier.
Any property can have a postal address and I have seen the Land Office plot number used as the address

Sure, Peter - I was just wondering why four or five people put up those signs this March, all on the same "street".
Houses in the village proper (like ours) only have the number displayed but these houses suddenly had street + number on those new signs ...
Or is there another explanation?

Hi John as to my contributions in the past to Zartkert 'Closed Garden Land'
I have recently Lost against a ruling over Building on such land as there is to last say Types one where the plot is on a main Road that is a therefore for all vehicle's the other is Privet Road witch my plot fell under On the Site Map main roads are not Highlighted as Privet roads have a Dash running down to the Plot this a road or lane where no public transport travels There fore on a Privet Road public transport as access Police Fire Ambulance services and rubbish collection last is septic tank collection can not Travel
AS regarding new build the main obstacle is septic tank and that with no access to empty septic tank it becomes a environment issue That is wye my application was rejected But there is nothing stopping some one putting in a septic tank on the quiet and only do a small change to living accommodation
I chose to use the new built store shed to put small bathroom in I then purchased a 6.5 meter caravan to convert to living accommodation But now order back to Uk and all stop Always remember they that the Planning Office as the Same Satretlight Tracing system as Uk the same Spy in the Skye so be careful digger47

This link produces a 'not found' error. However, Balatonfüredi Land Registry provides more information on the amendment: Zártkerti információ:2016. december 31-ig. which converts to not-too-bad English in Gooogle Translate.

I notice that two real-estate agents in Nagykanizsa are currently advertising zártkert properties.

And as pointed out in the Balatonfüredi Land Registry document the Zartkert once taken out of agricultural classification means that it is freed from agricultural regs. so you can buy multiple adjacent zártkerts and can still own / purchase an additional 1ha of agricultural land (e.g. the bit next door) to enlarge your smallholding/principality/whatever.
