Seek redress from the seller, he / she must have know about the issue and have chosen to keep their heads down in the hope a buyer would not be bothered. For me, it would be pay up seller or the deal is off.

Redress in the sense of a reduction in the selling price, yes, but the Vendors can't "keep their heads down", since the Notaire has all the Diagnostics info in the Dossier and will inform the buyers of any failings and future obligations.

is a reminder of all the Diagnostics immobiliers to be officially notified and if anything is failing and the buyers still wish to purchase, an amicable arrangement should be made between the two parties, which the Notaire will note in the Dossier.

Facade, everybody knows the state of play because there is a SPANC report on the table at the time of the sale and notaire will flag it up, so it's not really a case of the seller choosing to keep their heads down. Houses in France are sold/bought as seen. Whatever issues there are, the seller and buyer decide between them how to handle it.

The point behind the comment is I am a firm believer in "If it's not broke, don't fix it".....well until I get forced legally forced to and have no option.

Except, it doesn't if you actually think you're eventually going to have no option, because prices will only go up, and the money you got off the price 5 years ago might have got a new fosse then but might not in another 5 years time...
