We have been with our agent since purchasing our property in 2008. After many complaints from clients of the agents conduct and the cleanliness of the property we were looking to cancel our contract. However in September 2011 I contacted our agent chasing payment from our summer rentals. After many emails with no response he said he is having cash flow problems. He is in administration, then not, promised payment then nothing. He now accepts we want to terminate our contract but either 1: Continue with 2012 rentals and end contact, he promises to pay 2011 money !?! or 2: Terminate now and have to pay him compensation for loss of commission for 2012 & 13.

Can we terminate on breach of contract, ie: he did not pay us when stated in contract or do we have to rent this summer in hopes we will get 2011 and 2012 money?

I would contact a French Avocat if I were you to go over the contract you have.

Thank you. We have emailed some, sending them copy of our contract, but no one will say if he is in breach of contract unless we pay. Estimated 300 to 2000 Euro.

We have registered for a year with http://www.unpi.org

They are an advice group, we have paid only €75 for the year. The advisor we saw was an ex estate agent director.
It may be necessary to speak French, we are living in France and have had coproprieté problems.
