Divagation des chiens
Serious advice please.
We have a new Maire. A nice chap whom I know well, and get on with.
We have just received the Commune newsletter which states very bluntly
"Divagation des chiens? Elle est interdite."
What does that actually mean - of course I know it means keep dogs on leads, but does it mean everywhere?
(There has been a bit of a problem in the village with a family who just let their enormous dogs out all day).
We have four dogs. We walk them every day. The smaller ones (both 9 kilos) run free but stay very close - almost at heel. The two larger ones -both a bit under 25 kilos - (one half Staffy, half Beauceron and half gosh knows what, the other half blood-hound and half pointer) are on leads until we are a kilometre away, on chemins blancs where we let them off and they run through the woods and fields.
On the way back, the two big ones are back on leads at about the same point.
Do I have to keep the big ones on lead all the time? and the little ones too of course.

We were also advised that certain dogs must be on a lead at all times with a trained owner etc. (and a muzzle?) some time back. As usual rules are ignored; Rottweiler’s and other dangerous dogs roam around freely without owners. Also dogs are not allowed on the beaches but they are there a plenty.
The cops turn a blind eye for tourism sake.
Normal.
Well that’s around here anyway.

No comment on the uncivic (and unworthy) owners who allow their dogs to go walkies/do their business/fight with other dogs on their own.
If there are "dangerous" dogs not on leads, then a complaint can be made at the Mairie.
b-w - make sure your civil liability insurance covers any damage caused by your dogs when off the lead!

Hi,
Just to confirm what has been said and that your dogs can have their run, here is what the law says:
"Est considéré comme en état de divagation tout chien qui, en dehors d´une
action de chasse ou de la garde ou de la protection du troupeau, n´est plus sous la surveillance effective de son maître, se trouve hors de portée de voix de celui-ci ou de tout instrument sonore permettant son rappel, ou qui est
éloigné de son propriétaire ou de la personne qui en est responsable d´une distance dépassant cent mètres. Tout chien abandonné, livré à son seul instinct, est en état de divagation, sauf s´il participait à une action de chasse et
qu´il est démontré que son propriétaire ne s´est pas abstenu de tout entreprendre pour le retrouver et le récupérer, y compris après la fin de l'action de chasse"
So as long as they have a good recall, you are ok.

Well if "action de chasse" is literal, they are certainly okay! The smallest is absolutely convinced it is only a matter of time before he brings down a deer!

Our pair of Jack Russells are now walked on leads in certain areas, only because they go underground to hunt the ragondin. Disconcerting.
