Traveling Europe after brexit with criminal record

Default Traveling Europe after brexit with criminal record

Hi I would like to start by saying how my friend was given a simple caution last weekend for possession of a class a drug (cocaine). He has been reading up and is concerned that after brexit they might introduce a policy like Esta around Europe. Would this therefore mean they would be unable to travel through Europe or would the fact that simple cautions become spent inediately affect the decision in Europe (as I know it does not in the US) thanks for your time and any reply is appreaiated!

If a visa is required - there could be the need for a criminal record disclosure. If travel is visa-free, probably nothing to worry about.

It is very considerate for you to research this matter for your "friend".

Nobody knows the definitive answer to your question, and they won't until at least the end of Brexit negotiations. And unless Brexit results in continued freedom of movement, then it might be some time later before the European countries decide what sort of restrictions they might put on visitors from the UK.

Don't suppose you guys know if Europe cover the The Rehabilitation of Offenders Act or is that just the uk?

It only applies to the UK. Although no-one can give you a definite answer at this stage I would highly doubt a caution would prevent you from travelling even if an ESTA/ETA style system was introduced and applied to British citizens.

Thanks, my only track of thought behind this was that it stops entry into us, japan, china ext I was thinking they would follow suit with it being still classed as a conviction in most eyes

It doesn't stop entry. You may be required to declare it but in and of itself it doesn't stop you from travelling.

For anyone reading this if you have a criminal conviction you are almost worthless after brexit. UK citizens with criminal histories will be the most effected minority along with other foreign nationals. The UK is getting tough on migrants with records and in turn the rest of the EU will be tough on our convicts. Effectively the UK is your new prison. You won't be able to work and live abroad ANYWHERE without a visa and record checks so knuckle down and get used to the system that shafted you so badly. It's all you will ever know.

Free travel and work through Europe was the only escape from the UK we had. But you can kiss that goodbye.

Depressing is not even the word.

Did you really join the site just to post scaremongering rubbish?

You can't live in many countries of the world already without criminal record checks as part of a visa process, but possessing a criminal record doesn't mean an automatic rejection.

Don't they say "If you can't do the time, don't do the crime"? ..... Seems to apply equally well to effectively being confined to the UK.

I once purchased a passport and other identity verification setup for an NHS trust to verify job applicants, same system used at most airports. The Screen connectts to cloud based databases of all sorts of info, which is shared by most countries with this company, its in everyones interests really. They can scan and spot most dodgy passports, and if in doubt they have real people who remotely examine the docs. Things like lists of bankrupts, criminal records, financial info, all the american ‘dodgy person’ and ‘diplomatic risk’ familial links with dodgy info etc etc etc. EG if you manually search for barack obamas details, it’ll say he is a diplomatic vip and if you suspect dodgy dealings contact the state dept 24/7 contact at xxxxx. Real big brother stuff. Typically the customs guy doest search everything, but if they flag you or they do a second look, they know quite a lot about you... NB you cant just pop out to pc world any buy it, buyers are vetted too for use cases and intent. Not just any customer can get to all of the data available too, but immigration depts can.

For 85% of offenders with more than one conviction it does. Currently we are restricted to travelling and living in europe. If you can find one case where someone with previous convictions was given a working visa in a different nation I'll give you a medal. I guarentee you won't find a single case. Feel free to post a link if you do! The truth is brutal. But it's the truth all the same.

Do you have a bag of medals to hand out? ..... It happens in the US, and comes up for discussion in the US forum fairly frequently. Obviously the severity of the crimes committed impact the likely outcome, as does the age of the offender at the time the crime was commited, whether it was a single offence or repeated, and the time that has elapsed subsequent to the crime.

Drug offenses usually create an in surmounted obstacle for access to the US.

Canada also has a process for "rehabilitating" people with a criminal record.

Yes every case is looked at independently, and then REJECTED.

In all the years the internet has been in existence not a single person has decided to post an experience of being granted a working visa abroad despite criminal convictions.

I find this hard to believe. I challenge you, post a single link.

My post has NOTHING to do with America, but hey you guys have a habit of sticking your nose where it's not wanted don't you!

Effectively fellow ex cons as I said, the UK is your new jail. Only in special circumstances will convictions be bypassed. You can holiday where you like, but only a very small percentage of ex offenders will now be able to work or live abroad.

Ironic considering most of the YES voters probably have convictions!
