Default UK Visa

Hi, does anyone know if it will be easier to get my fiance here to the
UK from America rather then her get me there with her. We want to be
together and she wouldnt mind coming here to stay. We are looking into
the quickest route and best route. I read that it could be quicker to
get her here.
thanks
Chris

Moving her to the UK is by far the quickist route, moving you to the USA will take at the least 6 months

i'm not sure about the fastest way but it depends on what service center you're going there on visas here in the us because for example vermont is current on there k1 visas while nebraska (the longest) is working on september applications still...so it could be anywhere from 1-6 months depending what service center...

your fiance could hop on plane tomorrow and be here (uk) with you with no trouble
she can stay here (uk) for 6 months as a tourist anyway
u could then get married and apply for a visa almost immediatley that allows her to stay for a year as long as she wont be a drain on public finds
my hubby applied by post in the states and 4 days later he had his "entry clearance visa" in his hand
the UK look very favourably on visitors from the US...which i dont think is altogether fair even though my hubby is from the US

I have read recently that it is becoming difficult to change from a
tourist visa to a permanent status while in the UK. In this case it's
best to get the UK version of a fiance visa before arrival in the UK.
Post to misc.immigration.misc for more information

Hi, she came here on a visa waiver on feb the 3rd but was denied and
given 1 week temp leave because they werent satisfied she was a
visitor. At this point in time she was a visitor just coming to meet
my parents but because of the mess they got us into we decided to get
engaged before she went home. I complained to the IND many times and
they said they are willing to look at a more permanant visa for her to
stay.
Also we would like to get married in america and then come back here
to stay forever. Is this possible.

Yes, it is certainly possible to marry in America and return to the UK.
In that case you wife must obtain a UK spouse visa to enter the UK as
your wife. She must obtain this in advance before travelling to the UK.
You do not need a US visa to travel to the US, marry and then leave

Search for "visas" here

for example

The paperwork is much simpler than the corresponding US version

Ok, Bare with me for a little while. How do i go about getting the
visa. Can i apply for the spouse visa now even though we are not
married. We are definatly going to be married on the 1st of june. I
would like her to come back with me when i leave on the 10th of june.
Is this possible to do because i would like her to have the necessary
visa before she comes to our country because of what happened when she
came on holiday. If not wil i have to get a fiance visa and then bring
her over, then go to america in june and get married and come back.
Its all a bit complicated for me. I'd like her over here really soon
if possible but the weddings not til june but if i could apply for the
spouse visa now it would be going through the process and hopefully
should be ready by then.

I believe you would have to show proof of the marriage at the British
consulate in the US to obtain the spouse visa for the UK so it seems
unlikely you could get it before the marriage takes place

I don't understand what you've written here

If you are planning on getting married I don't understand why you are
interested in the fiance visa. If you want to get married in the US in
June but she has to come to the UK before that time can't she simply
enter the UK as a tourist before you travel together to the US to get
married? Then you can apply for the UK spouse visa. She should bring
proof of "ties" to the US in case they are needed since it is possible
she could be denied entry to the UK if it is determied she has
"immigrant intent" (I know this is the case for the US but I am not sure
how the IND views this kind of situation)

Hi, Well we would like all my girlfriends family to be there when we
get married and cause all of them are there it seems the best thing to
do. I read that we can do this somehow but i was not sure how its
done. If someone could tell me if we can apply for a spouse visa
before were married or whether i can bring her over once we're
married. She was sent back home after a week on the visa waiver cause
they were not satisfied she was entering as a visitor. It was stupid,
she was coming to stay for 5 months and then we were gonna go back to
america but for some reason they didnt believe her. I'm not sure
whether this will affect anything but i complained about it numerous
times. I just want her here. Any help is much appreciated.

I missed the beginning of the thread, but if you are trying to marry a US
citizen and have her move to the UK (either before/after marriage) to live
with you there then you really do need to go here and read up on the
options:

http://www.britainusa.com/visas/YesSettl.asp

Spouse visas are for spouses. Marriage certificate must accompany the
application according to the web page, so no you could not apply before you
marry.

Hi Chris............I was looking into this just the other day. It's relatively easy and painless when compared to you moving here to the US. Your Fiancee can either go to the British Consulate in NYC or she can apply through mail. Go here to find out more:

http://www.britainusa.com/visas/visas.asp

I think several people have posted this site already but it explains it all.

Cheers,

Leslie

But you can get the spouse visa in one day by turning up at the consulate,
with the correct documents - including a certified copy of your marriage
licence.
