Spouse visa refusal, Appeal or resubmit
 
I applied for my husband visa in July 2017. Refused October 2017 because they said bank statements and photos of engagement were missing therefore marriage is not genuine.

I had supplied both these in the original submission.

I involved the MP to ask for reconsideration but this was refused also because the immigration manager states that they were still missing.

I have already stated appeal process but want to know if I should resubmit instead? What is the appeal hearing time?

My solicitor says that I should continue with the appeal as I have no additional evidence before we got married that I can submit.

I had 60 pictures in total, pre engagement, engagement day pics, Skype pics, marriage days and after marriage pics.

So upset that even though I was externally through and had all the evidence they still refused it based on the immigration department not scanning them all!

Any advice would be great!!

Personally, if some of your supporting evidence was overlooked/ ignored/ lost, I would resubmit, with a fresh package of supporting records, making sure that everything is clearly marked and indexed.

My solicitor says that it could fail again and once a suspicion is cast on a case of a non genuine relationship then if can be refused again.

Does anyone have any idea how long the appeals are actually taking in the uk?

I would agree if the rejection was on the basis of a complete file, but when part of the file was lost/overlooked, I don't agree with that argument. .... Well it could fail again, but hopefully not for the same reason. If you submit a complete, clearly marked and indexed file, that should be unlikely.

If your documents were scanned you should be able to go to the office which scanned them and get evidence of what they scanned. There should be a digital file of the documents scanned.

Where did you get the documents scanned?

Yes, it fail again but if you don't appeal, complain etc then what are you going to do?
