Hi,

I'm just looking for confirmation from someone please.

Basically my wife was granted a spouse visa which is due to expire in a month's time but a year ago she was granted a Portuguese passport. Does that mean she can disregard the spouse visa and just continue living as normal on the back of the Portuguese passport as any EU citizen would or would the home office be expecting some sort of contact from her regarding her change in circumstances?

We have both left the UK and gone to various EU countries (Belgium) and she has returned to the UK on her EU passport, so I am assuming everything should be OK?

Yes, that's fine. Her EEA freedom of movement rights override anything else the moment she became a Portuguese citizen. Given the implications of Brexit it would be wise to apply for an EEA residence card however. Is your wife working at the moment?

Hi, she has worked recently but isn't working now, but she is looking and hopes to be in work by the end of March.

Does this affect things much?

Technically she can apply now but I would wait until she's working again and then apply for her EEA registration certificate.

So does any of this need to be done before article 50 is supposedly invoked or could she do the application a bit later? By later I mean maybe in April or May...

It can be done later. The only thing that will have an effect is when the UK leaves the EU which is two years away.
