Hi

I need some advice please

I have an ILR and recently gave birth to a baby boy in July, so by law, he
is a british citizen by birth. However, i have applied a malaysia passport
for him, therefore he has malaysian nationality.

We are going to travel to malaysia soon due to family emergency but I am
worried upon coming back to uk, my child will be refused an entry.

I had a look on the website that to apply for RoA it will take up to 6
months, in which we haven't got that much time to wait.

So, am i allowed to apply for RoA for my uk born baby from malaysia? What
is the timeframe if anyone knows?

Or must it be done in the UK before travelling since he was born here?

Or can i apply for the RoA after coming back from malaysia and just provide
his birth cert and my ILR to the immigration officer upon entering UK.
Would that be suffice?

Anyone with similar situation please help!

Malaysia is not a visa national country but it would be best to apply for your child's Certificate of Entitlement to the Right of Abode before you leave the UK. Anecdotally this is taking 3-4 months at the moment.

If that's too long to wait due to family reasons then you should apply for it from Malaysia. I should imagine processing times will be similar if not a little longer.

If that's also too long to wait than you should carry your child's full British birth certificate in your carry-on when you return to the UK. Present this together with their Malaysian passport and your ILR BRP/vignette and explain the situation. The Immigration Officer will normally use his or her discretion to permit your son to enter as a British citizen.

After deep thinking, i have decided to apply the RoA for my baby within the UK. I just cannot risk it.

I have filled in the form today and now preparing the supporting documents needed.

Can i just check with u or anyone if these are all thats needed please:

- 2 passport photo of the baby
- original passport of the baby
- original full birth cert of the baby
- mother's original BRP card (to prove my ILR)

Do i have to submit my original passport as well or photocopy would suffice?

And do i need to submit my husband's original passport as well as his BRP card? (He has PBS dependant visa not ILR)

Also how about our marriage cert? Do i have to submit that too?



Sorry for asking too much questions but i rather be safe than sorry 😅

Please advise. Thank youuuu 😄

Providing your ILR BRP was issued before your son was born then that should suffice. However I would include a colour photocopy of your passport as well for good measure.

No, those documents aren't necessary.
