Looks like Manslaughter.

Not the correct verdict, but at least she didn't try to find him not guilty entirely.

Given the available evidence, it looks like she is arriving at the correct verdict. Interesting how she cut the session short and after an extended lunch.

Maximum sentence could be 15 years. He has also been found guilty of another firearms offence, discharging a firearm in a restaurant

Judge Masipa got it wrong - IOL News | IOL.co.za

Thing is, the judge said

In relation to murder dolus eventualis, Judge Masipa said the question was whether Pistorius had foreseen the possibility of a death yet persisted in his actions that fateful evening.

“In the circumstances of this case the answer has to be no. How could the accused reasonably have foreseen that the shot he fired and kill the deceased?


“Clearly he did not subjectively foresee this as a possibility that he would kill the person behind the door let alone the deceased.”
which simply is not borne out by the evidence.

Without any direct threat to him (someone locked behind a bathroom door is threatened by what's outside, not the reverse, fairly obviously, by the evidence) he fired a line of bullets at about crotch height, with some serious ammo, across the toilet volume.

He obviously meant to kill whoever was inside. It's unreasonable to think anything else. That's what the line of bullets said.

Thus it should have been murder that was proven. Not premeditated, but still murder.

Judge got it wrong, and it's pretty likely that this will get appealed.

The judge said that as she understands the law, in order to prove murder, the offender must know who the person is who they intend to kill. The prosecutor was unable to prove that OP knew who was behind the door, therefore unable to find a conviction for murder. Pretty simple if you ask me.

Yes, I did wonder about that as well. He fired two dum-dum bullets, paused and then fired two more. He would have known after the first two shots that whoever was behind that door would be dead. Yet he fired two more.

After mulling it over: That could be the weakness of her argument. The fact that he killed the wrong person (and assuming we believe his story), he still clearly intended to kill someone - which is murder in my opinion.

Not really. As was stated in the proceedings, it could have been an intention to kill, it could have been an intention to wound, it could have been an intention to scare. What anyone believes his intentions are, are moot. The key here is beyond reasonable doubt and there is reasonable doubt so the murder conviction cannot stick. Really really simple.
