Default LPP v Spousal Permit

Hi all,

Looking for some guidance on the Life Partner Permits/Spousal Visas. Background - I am British (UK passport holder) and have been married to my South African wife for 4 years (together for approx. 10 year in total). We plan to move to SA to work/live etc.

1. When the 5 year limit is quoted on all sites to attain Permanent Residency (either LPP or Spousal route), is relationship length and/or marriage length taken into account? In other words, surely when you are married, the "clock" is not re-set to zero? If so, this would penalise being married as we have been married less than the 5 years - but actually been together in a relationship for double that length. As PR takes potentially 1 -2 years to process I believe that TR would be the best course of action to begin with?

2. If applying for a spousal visa, does my wife have to hold a South African passport? She was born in SA and has an ID book etc, but holds a British passport only (through descent). She is applying for an SA passport but I would like to know if I need to wait until this is completed before I start my process.

As always, any help is much appreciated.

Thanks

Al.
