EB1, here we come!

Wednesday 2 March 2011 - Rollercoaster?

I said right at the start that this would be a rollercoaster ride. Well, even I severely underestimated just how much of a rollercoaster this would be! The frustrations of the apparent slowness of the attorney, to the joys of finally submitting, to the anticipation of waiting for the receipt notice, to the intense few moments when I found out my case status, to the disappointment of an RFE, to the mixed reaction of my attorney to the RFE...

Ok, so we need to work on proof of my pay being in the top 10%. Both my attorney and I separately thought this was a no-brainer. Clearly not. So I need to go out and find more evidence to back up my claim, not helped by my having an unusual job title which makes comparison difficult. I keep thinking we'll win this one easily, but then I thought that first time round and it didn't happen. Rollercoaster again.

Next, intent to continue in my field of expertise. Due to a mix-up with the attorney, this was not submitted first time round, though I had both a personal statement of my intent, and an expression of interest from a small railroad company that matched my skills. So both pre-date my submission but I don't know if that will be sufficient.

A couple of other categories need substantiating and these are going to prove more difficult, especially given the timeframe. The RFE has an expiry date of 6th April (6 weeks) and as it took a week to arrive at the attorney's office, give a few days to get back, a few more days for my attorney to finalise the reply to the RFE, and I have about 3 weeks to get everything I need to the attorney. I've already submitted as much as I have already but I'd better get on with getting hold of the rest!

If I was nervous waiting for an initial decision, now I'm an absolute wreck with emotions in turmoil. Get a hold of yourself, man

About Me

My attempt to get an EB1a visa for the US, a person of extraordinary ability, which gives a green card pretty much immediately, and there is no waiting period unlike most other visas.
