EB1, here we come!

Friday 18 June 2010 - Preparatory questions

Now onto phase 2. This is where the attorney asks for lists of evidence to support my claim of "exceptional ability". He's already got a rough idea of the categories we're going for (minimum 3, we think I can get 5, out of 7). So he's formed a list asking for what I will provide for each category. For me this is where it gets slightly tricky. For stuff published on the Internet, do I just print it off? How does he - or more to the point the visa people - know that it's genuine? What about my position at work, showing to be in a senior/management position - without arousing the suspicions of my employer ("why do you want this?"). Hopefully the attorney will get back to me soon on those. This will go back and forth a couple of times until he's happy with the evidence types. No doubt some will he will consider as irrelevant or unsubstantiated, but then might think of other pieces to include. I remembered something else myself the other day. Anyway, I've sent the first list off to him so we'll see what comes of that. In the meantime, I'm off on holiday, down to sunny (hopefully) Cornwall for a week!

Hmmm, no I didn't! Perhaps it's the fact that most evidence you supply has to be backed up with further evidence which substantiates the first evidence. So, for example, a reference letter from somebody needs to have associated evidence that shows who that person is (news reports, committee hearings, published papers, etc). Statistical pay reports need to be backed up with reports about the company that produced those reports. Maybe the reasoning is nobody is going to want to, or be able to, fabricate all of that evidence in a convincing way.

I guess that makes sense. I'm just over analysing absolutely everything. I'm applying as an actress (already on the O1) and I think about things like playbills - what's to stop anybody, for instance, having professional playbills made up to look as though they've performed in the lead in these plays? So I guess it makes sense to have letters of support backing it up, plus I have my imdb.com page and Spotlight etc. It just seems as though it wouldn't be too hard to fabricate a lot of stuff, and as an immigration officer I would be very aware of that!

Congrats on your approval though, hopefully that will be me in a few months time!
