Get a tea/coffee this might take a while, I've had another cry over this.
Just came off the phone about half an hour ago with the solicitor and this is how the saga stands at the moment.
Our garage is the boundary wall to our next door neighbour but when the house builder marked up the boundary for the land registry a mistake has happened. They have included our garage with their garden. Our boundry is marked out as just our drive way.
The buyer is not willing to procede until this has been sorted.
They contacted the Land Registry and the Land Registry is not happy just to change the plans they want to send a surveyor over. The surveyor can't come until he has permission from next door which is a rented property. So by the time everyone is informed it may take weeks!
On top of all this I am not sure if we will have to cough up the money to have all this changed.
We are not using the same solicitors we used to buy the house eight years ago and from a previous blog post I told you all about the fact that they have shredded our documents without informing us before doing it. When we brought the house none of this came to light which means they must not have acted for us appropriately the first time round. We never brought this house from new either. I kind of wish now we did go that solicitors then they would have to sort out all this mess they have left us in.
I have been informed that the buyer still wants the house which is a plus but you and I know he could really pull out at any time.
Nervous times indeed.

We have receieved a letter from the Land Registry today saying they will be sending out a surveyor in the next two weeks, looks a very standard letter to be honest.
I have also decided today to write a letter to the original solicitor who acted on our behalf almost eight years ago to see how and why this error has happened that he has omitted to spot this mistake. If it has been spotted by another solicitor this should never have happened.

We have receieved a letter from our solicitor today with a copy of what our buyers solicitor have wrote. The main part of the letter states:
If they agree, as our client does, that the land is actually occupied by xx, then they will have to send notice to number xx (our neightbour) to say they will exclude the land from their title and, if there are no objections, the land will be removed from number xx (our neighbour's) title number. Clearly we do not know how long number xx (our neighbour) will be given to raise objections, but our client is not willing to proceed until we are advised the registration issue has been resolved
There are a couple of points that I need to have cleared up with the Land Registry.
1. What do they mean objections, the garage is clearly our garage. In our plans it is shown as our garage.
2. There is really going to be a time limit on something that was quite clearly a mistake by either the house builder or the Land Registry. Why do we have to suffer.
The Estate Agent phoned just before because she has only just got this information, she says that the buyer really does want the house. He wants the issue sorting which you have to see from his point of view. I have sent a copy of this letter to our original solicitor that we used to buy the house back in 2000.

Well, the Land Registry chap has been today. He wasn't here that long really and I asked him how long this was going to take from here. He said I would be better phoning the office on Friday to see if a notice will need to be given to next door with regards to the changes. So yet again more waiting.

Just got off the phone to the Land Registry and they have informed me that a notice has now been served to our nextdoor neighbour and he has until 17th October to object. He could send off a reply slip before hand to make it quicker but unfortunatley I don't think he would go out of his way. So I am not holding my breath. See you again after 17th October but the lady has informed me that she will call me if they receive anything before hand.

I just thought I would air my feelings now that we are at the end of the second week wait. I was just thinking this morning as I took my washing to the dryer that it would be just our luck for the land lord next door to air his objections at the end of next week. What is the chance, that we could have such bad luck like that?
Neil and I were also talking last night at the thought of our buyer asking for even more money off the house, even though he has still got a great deal compared to the other houses near us. We also got thinking of if the buyer was to drop out and what this would mean to everything. Not only would we not be able to go to Canada, we would both be able to leave our house at all. How long would it be before we got another buyer, how much further would house prices fall, we would have to stay and weather all the storm.
I know I don't seem to be looking positive but lets be honest these are really bad times. I don't think the ecomony is going to be able to pick its self up for years. I really feel sorry for all the people out there that are only paying the interest on their mortages because they wanted their own house. Everything is such a mess out there at the moment I hope it picks up for everyone sooner rather than later.

Well, I phoned the Land Registry today to see how things are moving along and the lady has assured me that everything is going to be in the post tonight, just as I was typing my solicitor rang confirming all this.
Hopefully a 31st October date will be agreed as this is what we are aiming for now, fingers crossed.

Solicitor and Estate Agents have both confirmed that we have a completion date. The big date is 10th November thank god for that. Looking back I never thought we were going to get there its been months of HELL. Its about time I had some good news.
